Les professeurs Macey et Miller analysent la relation entre l’assurance des dépôts et l’ inadé quation dans la structure des échéances des actifs et passifs des banques commerciales. Après avoir critiqué l’hypothèse traditionnelle concernant la réglementation, d’après laquelle les banques sont incitées à financer les actifs à long terme par des passifs à court terme parce que l’assurance des dépôts garantie par l’Etat stimule le crédit des banques et subventionne les passifs à court terme, ils utilisent l’analyse économique des décisions (...) publiques pour soutenir qu’une version modifiée de l’hypothèse de la réglementation est la meilleure explication de la déstructuration des échéances des actifs et passifs bancaires.Finalement, ils considèrent que soutenir l’hypothèse de la réglementation n’entraîne pas l’ acceptation du modèle d’assurance des dépôts garantie par l’Etat tel qu’il existe aux Etats-Unis aujourd’hui.Professors Macey and Miller explore the relationship between deposit insurance and the mismatch in the term structure of commercial banks’ assets and liabilities. After criticizing the traditional regulatory hypothesis, which posits that banks have incentives to fund long-term assets with short-term liabilities because government-sponsored deposit insurance enhances bank credit and subsidizes short-term liabilities, they use public choice theory to argue that a modified version of the regulatory hypothesis is the best explanation for the mismatch in the term structure of banks’ assets and liabilities. Après avoir étudié les écrits de saint Anselme (Dire l'ineffable, 1984), Paul Gilbert a questionné la métaphysique classique, sous l'influence de la philosophie réflexive (La Simplicité du principe, 1994). Il a ensuite souligné les chances offertes à la réflexion fondamentale par l'analogie, thème classique mais oublié (La Patience d'être, 1996, et Sapere e sperare, 2003). Plus récemment, (...) il a abordé la question de la violence, ce mal- être si commun (Violence et compassion, 2009). En 1997 déjà, son travail a été récompensé du prix Cardinal Mercier de l'U.C.Louvain-la-Neuve. Durant de nombreuses années, Paul Gilbert a été professeur invité à l'Institut catholique de Paris. A l'occasion de son éméritat dans cette institution, un colloque y a été organisé. Dans leurs communications, S. Bonanni, Ph. Capelle-Dumont, S. D'Agostino, E. Gabellieri, J. de Gramont, 1. Malaguti, R. Repole et E. Tourpe reprennent et développent l'élaboration de la pensée de Paul Gilbert. Desire Joseph Mercier (1851-1926) was founder and first president of the Institute of Philosophy of the Catholic University of Leuven. After his studies in the classics, philosophy, and theology at the seminary of Mechelen, Mercier was ordained (1874), obtained a licentiate in theology at Leuven (1877), and became professor of philosophy at Mechelen the same year. In 1922 he was commissioned to inaugurate the chair of Thomistic philosophy created at the University of Leuven at the request of Pope (...) Leo XIII. Mercier endeavored to realize the program formulated in the encyclical Aeterni Patris (1879): to restore the philosophy of St. Thomas Aquinas, harmonize it with the progress of modern science and thought, and extend its influence to the scientific and social disciplines. On the basis of his initial success, he asked for, and received, the support of the Pope for the creation of an Institute of Philosophy that would provide a complete education in the various philosophical areas. When named president of this institute (1899), Mercier gathered collaborators from among his first students and with their assistance formed an international group of enthusiastic and devoted disciples. The Revue Neo-scolastique made the writings of the institute available throughout the scholarly world. On Feb. 7, 1906, Mercier was named archbishop of Mechelen. This essay zooms in on a series of parentheses in Derrida’s Politics of Friendship in order to examine a somewhat failed encounter between deconstruction and Donna Haraway’s ontological discourse on kinship and companion species. The essay claims that Derrida’s notion of trace, as it exceeds the humanist-anthropocentric logic and challenges any simple division between humankind and animality, can be followed as a condition for thinking friendship, kinship, or companionship as non-strictly anthropological categories, and for accounting for a principle of failure (...) or fallibility at the very heart of the ‘encounter’ with the other – human or nonhuman. What Derrida calls ‘the possibility of failure’ is inseparable from a certain legibility and illegibility of friendship, kinship, and companionship, from their dependence on the trace-structure, suggesting that they do not have strict ontological consistency (pace Haraway) but are structurally differantial and heterogeneous, and therefore remain to be read, interpreted, attested, translated, perhaps in view of transformative deconstruction. Reading and, with it, fallibility and undecidability, contribute to problematising Haraway’s ontology of companionship, making-kin, and becoming-together. Moreover, from the perspective of the exegesis of deconstruction, the essay also claims that the problematic of the trace-structure – virtually limitless in Derrida’s corpus – presupposes, everywhere it appears, the interrogation of the anthropological machine, of human exceptionalism, and raises the ‘question of animality’ even when this ‘question’ is not formulated as such, and when the so-called ‘animal’ is not named as such. As they make their way through Louis Althusser’s and Jacques Derrida’s texts, readers will cross innumerable curtains – ‘the words and things’, as Derrida says, as many fabrics of traces. These curtains open onto a multiplicity of scenes and mises en scène, performances, roles, rituals, actors, plays – thus unfolding the space of a certain theatricality. This essay traces Althusser’s and Derrida’s respective deployments of the theatrical motif. In his theoretical writings, Althusser’s theatrical dispositive aims to designate the practical and (...) material dimension of the scenes of ideology, materially enacted through roleplays, performances, acts, or discourses. At the horizon: a scientific discourse on ideology or, later, a strategic intervention in the class struggle. This scientific and/or strategic orientation echoes Althusser’s definition of materialism: ‘no more storytelling’. But Derrida’s ‘closure of representation’ reminds us that there’s no presence – even the most ‘material’ – no ‘truth’ or ‘correctness’ – in theoretical or strategic terms – without effects of re-presentation, differential repetition, narrative reconstruction: theatricality and materiality suppose a force of resistance, a secret heterogeneity, curtain foldings. Hence the irreducible necessity of reading, storytelling, transformative interpretation. This essay examines Étienne Balibar's readings of Jacques Derrida and deconstruction. The text is framed as a review of two books by Balibar: 'Equaliberty' and 'Violence and Civility'. After describing the context of those readings, I propose a broader reflection on the ambiguous relationship between 'post-Marxism' and 'deconstruction', focusing on concepts such as 'violence', 'cruelty', 'sovereignty' and 'property'. I also raise methodological questions related to the 'use' of deconstructive notions in political theory debates.

We agree with Cushman that rationalizations are the product of biological adaptations, but we disagree about their function. The data available do not show that rationalizations allow us to reason better and make better decisions. The data suggest instead that rationalizations serve reputation management goals, and that they affect our behaviors because we are held accountable by our peers.

This book offers a critical introduction to the work of American philosopher D. G. Leahy (1937-2014). Leahy's fundamental thinking can be characterized as an absolute creativity in which all creating is 'live' -- a happening occurring now that manifests a supersaturated polyontological actuality that is essentially created by the logic that characterizes it. Leahy leaves behind the categorial presuppositions of modern thought, eclipsing both Cartesian and Hegelian subjectivities and introducing instead an essentially new form of thinking founded in a nondual (...) logic of creation. The new thinking delineates the absolute unicity of existence as a creative interactivity beyond all traditional dichotomies (such as one vs. many, unity vs. plurality, identity vs. change): a fully "digitized" actuality that is nothing but newness, which inherently implies nothing but change. Through this new form of thinking, change itself is revealed to be the very essence of reality and mind. Any reader looking for a quantum leap beyond the thrall of modern and postmodern fixations is invited to hear and apprehend this new thinking that refuses to be conditioned by paradigms, categories, species, genera, walls, bridges, boundaries, or abstractions: an essentially free thinking that embodies creative novelty itself. Reason, we are told, is what makes us human, the source of our knowledge and wisdom. If reason is so useful, why didn't it also evolve in other animals? If reason is that reliable, why do we produce so much thoroughly reasoned nonsense? In their groundbreaking account of the evolution and workings of reason, Hugo Mercier and Dan Sperber set out to solve this double enigma. Reason, they argue with a compelling mix of real-life and experimental evidence, is not (...) geared to solitary use, to arriving at better beliefs and decisions on our own. What reason does, rather, is help us justify our beliefs and actions to others, convince them through argumentation, and evaluate the justifications and arguments that others address to us. In other words, reason helps humans better exploit their uniquely rich social environment. This interactionist interpretation explains why reason may have evolved and how it fits with other cognitive mechanisms. It makes sense of strengths and weaknesses that have long puzzled philosophers and psychologists--why reason is biased in favor of what we already believe, why it may lead to terrible ideas and yet is indispensable to spreading good ones.--. “It's almost like putting salt in a wound, for this person who's already made a very difficult decision,” suggested Meghan Patterson, a licensed obstetrician-gynecologist whom we interviewed in our qualitative study of the experiences of North Carolina abortion providers practicing under the state's Woman's Right to Know Act. The act requires that women receive counseling with state-mandated information at least twenty-four hours prior to obtaining an abortion. After the law was passed, Patterson worked with clinic administrators, in consultation with a (...) lawyer, to write a script to be used in the state-mandated counseling procedure. She and her colleagues took particular steps to mitigate the effects of what she described as HB 854's “forced language”—such as referring to the “father of the child.” While HB 854 stipulated that patients must be informed of the medical risks associated with the particular abortion procedure as well as those of carrying the child to term, Patterson's script made explicit the magnitude of comparative risks, emphasizing that the risks of carrying a pregnancy to term are substantially greater than the risks of an early-term abortion. She felt that these contextualization strategies helped to facilitate trust and rapport in a clinical care situation that proved relationally and morally challenging. In this article, we take up and expand on this point by elucidating an empirically grounded approach to ethically justified care when health care providers face legal or institutional policy mandates that raise possible moral conflicts. Our approach builds on recent bioethics discourse addressing conscience in the practice of medicine. While the concept of conscience has broad philosophical underpinnings relating to moral judgment, agency, and discernments of right and wrong, debates in bioethics have tended to engage the concept primarily vis-à-vis rights of conscientious objection or refusal. Here, we suggest a broader frame for thinking about claims of conscience in health care. Our approach draws on the feminist bioethics and the ethics of care literatures to highlight how providers may be motivated by matters of conscience, including relational concerns, in the active provision of certain forms of care. What emerges are two possibilities: not only conscientious refusal to comply with a policy mandate but also conscientious compliance—working conscientiously within a mandate's confines. (shrink)

Developmental research suggests that young children tend to value dominant individuals over subordinates. This research, however, has nearly exclusively been carried out in Western cultures, and cross-cultural research among adults has revealed cultural differences in the valuing of dominance. In particular, it seems that Japanese culture, relative to many Western cultures, values dominance less. We conducted two experiments to test whether this difference would be observed in preschoolers. In Experiment 1, preschoolers in France and in Japan were asked to identify (...) with either a dominant or a subordinate. French preschoolers identified with the dominant, but Japanese preschoolers were at chance. Experiment 2 revealed that Japanese preschoolers were more likely to believe a subordinate than a dominant individual, both compared to chance and compared to previous findings among French preschoolers. The convergent results from both experiments thus reveal an early emerging cross-cultural difference in the valuing of dominance. (shrink)

Often, when several norms are present and may be in conflict, individuals will display a self-serving bias, privileging the norm that best serves their interests. Xiao and Bicchieri (J Econ Psychol 31(3):456–470, 2010) tested the effects of inequality on reciprocating behavior in trust games and showed that—when inequality increases—reciprocity loses its appeal. They hypothesized that self-serving biases in choosing to privilege a particular social norm occur when the choice of that norm is publicly justifiable as reasonable, even if not optimal (...) for one of the parties. In line with the literature on motivated reasoning, this justification should find some degree of support among third parties. The results of our experimental survey of third parties support the hypothesis that biases are not always unilateral selfish assessments. Instead, they occur when the choice to favor a particular norm is supported by a shared sense that it is a reasonable and justifiable choice. (shrink)
